In your last real negotiation, was there something true you didn't say — a constraint, a priority, a trade you'd happily have accepted — because you couldn't see how to say it without handing over leverage? You walked out with the smaller deal. Somewhere between then and now, that silence got promoted from caution to strategy.
Robert Mnookin, professor at Harvard Law School and chair of its Program on Negotiation, wrote Beyond Winning (2000) with Scott Peppet and Andrew Tulumello to explain a failure they watched lawyers repeat: both sides know a better settlement exists, and neither can get to it. The bind already had a name. Lax and Sebenius, who opened this elective on Day 96, called it the negotiator's dilemma in The Manager as Negotiator. Creating value requires disclosure — of priorities, of constraints, of the trades you'd accept — while claiming value rewards concealment, and rewards using whatever the other side disclosed. Each party sees the exposure, each says less than it knows, and a deal that could have been larger for both gets carved up small and slowly instead.
