The question

Take the largest deal open to you this morning: can you name every person whose yes it needs, the order you mean to reach them in, and the one issue you'd add to the list to make the whole thing easier? Most preparation stops at choosing what number to say first, which is the smallest of those decisions and the only one anybody rehearses.

The idea

David Lax and James Sebenius have written together since The Manager as Negotiator in 1986; Sebenius teaches negotiation at Harvard Business School. In November 2003 they published '3-D Negotiation: Playing the Whole Game' in Harvard Business Review, and expanded it into a book three years later. Their claim is that most negotiators work only one dimension of a three-dimensional game. The first is tactics: what happens at the table, the persuasion, the reading of the room. The second is deal design: the structure of the agreement, the issues on the list, the contingencies that turn an argument about the future into a clause. The third is the setup — the moves made away from the table that settle who's negotiating, over what, in what sequence, and against what alternatives. Setup isn't the preamble to the negotiation; most of the time it is the negotiation. It also collects the fewest hours of the three, and the reason is easy enough to see: tactics are visible, dramatic and immediate, while setup is quiet, undramatic and usually decisive. The trap is accepting whatever table you're offered and then trying to win at it.
