Sample frameDay 122·Negotiation · Trade

Morning. The most useful thing you'll say across a table this week ends in a question mark.

Negotiation.

The Calibrated Question

The question

Somewhere in your current deal is a line you've now sent three times in a slightly firmer voice; hand them the constraint instead and ask how they'd work inside it. What comes back is the thing you've been guessing at for a fortnight — so what is the fourth repetition for?

The idea

You've already borrowed from Chris Voss once, on Day 9, for the bracket. Never Split the Difference (2016) is the fuller argument, and its central instrument is the calibrated question: an open question, beginning with how or what, that cannot be answered yes or no and that hands your problem to the person across the table. How am I supposed to do that is the one everybody quotes. Delivered as an accusation it's theatre. Delivered flatly, with a real constraint sitting behind it, it obliges them to look at your position and work inside it, and people defend a solution they helped build far more readily than one they were handed. Voss is firm that why is the exception, because in almost any language it lands as an accusation and pushes the other side into defence. Under pressure the instinct runs the other way: you restate your position more slowly and more loudly, and call that negotiating.
